Legislation Under Review

The following bills are currently under consideration or have been voted upon in the Pennsylvania House of Representatives and/or its committees.  This page will be updated throughout the 2011-12 legislative session to keep you informed of the legislative process.  To obtain additional information about each proposal, click on a bill number.

House Bill 9 would update the state’s teen driver licensing laws.

 

House Bill 270 would amend Title 18 (Crimes Code) by adding a section which provides that a person who, at the time of sentencing, has been convicted of another offense under Section 6312 shall be sentenced to penalties associated with second or subsequent offenses, regardless of whether judgment of sentence has been imposed for the prior violation.

 

House Bill 377 would amend the Pennsylvania Construction Code Act (Act 45 of 1999) to clarify application of Uniform Construction Code (UCC) exclusions to Industrialized Housing Act; enact alternative energy standards for log homes; eliminate residential automatic sprinkler mandate; and adopt 2012 International Residential Code (IRC) standards for fire protection of floors.

 

House Bill 495 would establish that a benevolent gesture or admission of fault made by a health care provider to a patient or his relative/representative regarding the patient’s discomfort, pain, suffering, injury or death resulting from a medical encounter, treatment or procedure shall be inadmissible as evidence of liability or as an admission against interest if made before commencement of any medical professional liability action.

 

House Bill 705 would amend the County Code to permit the county commissioners to abolish the office of jury commissioner.

 

House Bill 707 would amend the Second Class County Code to permit the county commissioners to abolish the office of jury commissioner.


House Bill 87 would require unannounced inspections of certain facilities and persons that provide child day care.

 

House Bill 262 would move the Pennsylvania Gaming Control Board’s (PGCB) Bureau of Investigations and Enforcement (BIE) to the Attorney General’s office.

 

House Bill 378 would require at least one member of the Civil Service Commission to be a veteran.

 

House Bill 391 would restrict the appointment of legislators and executive level public employees to the Gaming Control Board during their term of office/employment and one year thereafter.

 

House Bill 497 would define the powers and duties of ex-officio members of the Gaming Control Board.

 

House Bill 162 would increase the grading of the criminal offense of invasion of privacy if the victim is a minor.

 

House Bill 201 would add private residential rehabilitative institution (PRRI) employees to the protected class under the state’s aggravated assault statute and expands the definition of “school grounds” in the criminal trespass statute to include PRRIs.

 

House Bill 270 would deem a person to have been convicted of a prior offense under the child pornography statute whether or not he or she has been sentenced on the previous conviction.

 

House Bill 442 would prohibit the imposition of private transfer fees and requires disclosure of existing private transfer fees.

House Bill 208 would increase the minimum term of imprisonment for hit-and-run accidents involving death or personal injury from one year to three years.

 

House Bill 317 would add an aggravating circumstance to be considered in conjunction with a first-degree murder conviction (whether the defendant perpetrated a sexually violent offense and was a registered sex offender). 

 

House Bill 344 would amend the Public Utilities Code to provide the PUC with regulatory oversight with respect to the safety of certain activities related to the natural gas transportation process. 

 

House Bill 365 would amend the Controlled Substance, Drug, Device and Cosmetic Act to include salvia divinorum as a Schedule I substance.

 

House Bill 1 would reform Pennsylvania’s liability law to create proportional liability, requiring parties in a lawsuit to only be responsible for their share of damages or injury.

 

House Bill 140 would create a freestanding act entitled the Methadone Death and Incident Review Act.  The Department of Health also shall conduct a death review for all deaths where methadone was either a primary or secondary cause of death. 

 

House Bill 176 would amend the Controlled Substance, Drug, Device and Cosmetic Act to include synthetic marijuana and associated compounds as a Schedule I substance.

 

House Bill 520 would amend the State Lottery Law to create a PA Lottery winnings intercept for state delinquent taxes.

 

House Bill 705 would amend the County Code to permit the county commissioners to abolish the office of jury commissioner.

 

House Bill 707 would amend the Second Class County Code to permit county commissioners to abolish the office of jury commissioner.

 

House Bill 915 would decrease state funds allocated to public education in the 2011-12 state budget and replaces them with federal funds.

 

House Bill 986 Amends the State Lottery Act to provide a four-year extension of the PA Lottery mandated return rate of 27 percent.
